Terms and Conditions

These Terms and Conditions ("Terms") govern the use of the Play Peak e-store ("Website"), owned and operated by Distream OÜ, a company registered in Estonia (reg. no. 16319092, VAT no. EE102414905, address: Sakala tn 7-2, 10141 Kesklinna linnaosa, Tallinn, Harju maakond).
By placing an order through our Website or otherwise engaging with us, you (the "Customer") agree to be legally bound by these Terms. These Terms also apply to any purchases made outside the Website (e.g., via email or other recordable channels).
1. Definitions

Seller refers to Distream OÜ (trading as Play Peak), registry code: 16319092, located in Estonia.

Customer refers to any individual or legal entity placing an order.

Product(s) refers to any item(s) available for sale via the Website.

Website refers to the online shop at https://www.playpeak.ee.

Agreement refers to this legally binding document between the Seller and Customer.
2. General Terms
2.1 All relations between the Seller and the Customer are governed by Estonian law.
2.2 The Seller may update these Terms at any time. Updates will be published on the Website, and the version in force at the time of purchase will apply.
3. Product Information
3.1 All Products displayed on the Website are either in stock, available for pre-order, or virtual (where applicable). Availability is subject to real-time changes.
3.2 Product images are for illustrative purposes only and may not fully reflect the actual item.
3.3 If a Product is unavailable after purchase, the Seller will notify the Customer to offer a new delivery date, a substitute, or a full refund within 14 days.
3.4 Products may carry age or usage restrictions. Customers are responsible for complying with these.
4. Prices and Payment
4.1 All prices are in euros (€) and include VAT. Shipping costs are shown separately before order confirmation.
4.2 Promotional prices show both original and discounted prices.
4.3 Payments are made securely through external service providers.
4.4 In case of obvious pricing errors, the Seller reserves the right to cancel the order and refund the payment.
5. Ordering and Contract Formation
5.1 Orders are placed via the Website. The contract is binding once full payment is received.
5.2 The Customer must provide accurate personal and delivery information. The Seller is not responsible for issues due to incorrect details.
6. Delivery
6.1 Estimated delivery times are shown on the Website. If not specified, the Seller will provide this upon request.
6.2 Orders are typically fulfilled within 1–4 working days within Estonia, unless otherwise stated. Longer delays for pre-orders or out-of-stock items will be communicated.
6.3 Delivery is via parcel lockers (Omniva, Itella/SmartPost, DPD) or other logistics partners. Free shipping is offered for orders over €50 in Estonia and EU.
6.4 The risk of damage transfers to the Customer upon receipt of the goods.
7. Right of Withdrawal and Returns
7.1 EU customers have the right to withdraw within 14 days of delivery, without stating a reason.
7.2 The Customer must notify the Seller in writing (e.g., info@playpeak.ee) and return the product within 14 days.
7.3 Return costs are borne by the Customer unless the product is defective or incorrect.
7.4 Returned items must be unused, in original packaging, and complete with all components and tags.
7.5 No return is allowed for:

Opened booster packs or sealed collectible items

Digital goods

Custom or personalized products
7.6 Refunds are processed within 14 days of receipt of the returned item, using the original payment method.
7.7 If the returned item is damaged or incomplete, the Seller may deduct an appropriate amount from the refund.
8. Warranty and Complaints
8.1 A 2-year statutory warranty applies to all products purchased by consumers in the EU.
8.2 Legal entities receive a 1-year warranty, unless otherwise agreed.
8.3 The warranty covers manufacturing defects but not normal wear, misuse, or external damage.
8.4 Complaints must be submitted in writing to info@playpeak.ee as soon as the defect is discovered.
8.5 In case of a legitimate claim, the Seller will offer a repair, replacement, or refund in accordance with law.

9. Liability
9.1 The Seller’s liability is limited to the value of the product sold.
9.2 The Seller is not responsible for indirect or consequential damages unless caused by intent or gross negligence.
9.3 The Customer agrees to use the Website and services in accordance with the law and good practice.
10. Privacy and Data Processing
10.1 All personal data is processed in accordance with the General Data Protection Regulation (GDPR) and Estonian law.
10.2 We collect and process personal data for order fulfillment and customer service. More details are available in our Privacy Policy.
10.3 Payment data is processed via secure, encrypted channels and is not accessible to the Seller.
10.4 Customers have the right to access, correct, or request deletion of their personal data at any time.
11. Amendments
11.1 These Terms may be updated at any time. Changes will be posted on the Website.
11.2 The Terms valid at the time of purchase apply to each transaction.
11.3 By checking “I agree to the Terms and Conditions” during checkout, the Customer confirms having read and accepted these Terms.
12. Governing Law and Dispute Resolution
12.1 These Terms are governed by Estonian law.
12.2 Any disputes should first be resolved through negotiation. Failing that, consumers may turn to:
